June 2019 • KitchenBathDesign.com 17 U.S. Preliminary Decision Due On Potential Duties For Chinese Cabinets WASHINGTON, DC — U.S. trade officials are to make a preliminary determination regarding potential countervailing duties in the wake of charges that unfair Chi- nese trade practices in cabinet/vanity manufacturing and exporting are seriously undermining the businesses of U.S. cabinet suppliers. A decision by the Commerce Dept. regarding the duties is expected on or about May 30, prior to press time for the current issue of Kitchen & Bath Design News. A preliminary anti-dumping duty determination is scheduled for Aug. 13, ac- cording to a spokesperson for the U.S. International Trade Commission (USITC), which is also mulling an unfair-trade petition filed by the American Kitchen Cabinet Alliance (AKCA), a coalition of cabinet manufacturers and component suppliers with ties to the Kitchen Cabinet Manufacturers Association (KCMA). The AKCA – formed this year expressly for the purpose of fighting dumped and subsidized Chinese cabinet/vanity imports – has charged that, as a result of unfair trade practices, imports of lower-cost, Chinese-made kitchen cabinets and vanities into the U.S. have risen sharply in recent years, posing an existential threat to the $9.5-billion U.S. cabinet trade. The AKCA is seeking to have U.S. trade officials im- pose anti-dumping penalties on the Chinese, whose manufacturers and exporters have long benefited from government subsidies and other economic programs. The USITC initially determined that there "is a reasonable indication" that the U.S. cabinet industry "is materially injured by imports of wooden cabinets and vanities from China that are allegedly subsidized and sold in the U.S. at less than fair value." However, both the USITC and the Commerce Dept. must reach affirmative final determinations in order for anti-dumping and countervailing duty orders to be formally issued. The decisions come at different points, as part of an investigatory process that could take up a full year to run its course. The USITC preliminary phase injury decision clears the way for the Commerce Dept. to move ahead with its anti-dumping and countervailing duty investigations. According to AKCA estimates, approximately $1.4 billion and $2 billion in Chi- nese cabinets and vanities, respectively, are currently being imported annually into the U.S. from China. On a unit basis, the imports comprise more than 30% of the U.S. cabinet market, the AKCA contends.
